Terms and Conditions
General
By connecting to our websites or logging into our multiplayer server, you agree to abide by all Rules and follow directions from Staff members, in addition to the terms presented below.
You are responsible for your use of the Services, for any Content you post to the Services, and for any consequences thereof. The Content you submit, post, or display will be able to be viewed by other users of the Services and through third party services and websites. You should only provide Content that you are comfortable sharing with others under these Terms.
Definitions
"Staff" are defined as users ranked as Staff Manager, Administrator, Community Manager, Moderator, Support that preside over PvPHub related management or websites directly associated with The PvPHub server.
The role "Executive" is considered and has the same rights and privileges as staff, is considered a different status because they represent the server.
"Content" includes, but is not limited to:
• player data-files
• anything created or obtained while playing on The PvPHub server such as:
• blocks, Items, Entities within the multiplayer server
• player or container inventories
• images, such as screenshots
• builds (block placements or manipulations)
• anything at all (text, images, data-files, etc.) submitted to: PvPHub.me
• Any other PvPHub affiliated online or offline asset or contact medium.
• your username and likeness
(PvPHub does not have access to nor does it make any claims on your Minecraft password or account. This clause refers only to your username itself, and any skins or images or other depictions of yourself or your character made available to PvPHub.)
Purchases
All purchases made through PvPHub are entirely optional and are considered digital goods/services. These purchases may grant in-game perks, ranks, or benefits as outlined on our webstore at the time of purchase. By purchasing from PvPHub, you agree to these Terms and Conditions.
Perks and benefits associated with a purchase are not essential to gameplay and may be modified, added, or removed at any time for reasons including but not limited to game balance, technical limitations, or server performance. We will generally tend to add, and not remove, perks, but situations arise where it may become necessary to do so. Our priority is user experience, and we do not aim to arbitrarily remove perks or reduce value. At our sole discretion, if a material perk is permanently removed, we may choose to provide an alternative of comparable value. Minor or cosmetic perks may be removed without replacement.
Service downtime, maintenance, server restructuring, suspension or punishment on the server, changing your mind, or disagreeing with a decision made by PvPHub staff are not valid grounds for a refund. Refunds may only be considered if a purchased product is not delivered as described at the time of purchase.
Refund Policy
All products sold by PvPHub fall under this policy. For any questions, please contact our support team.
- Changing of Mind
- Refunds for a change of mind are generally not provided. In exceptional cases, a refund may be granted at the sole discretion of authorized staff.
- Unintentional Purchases - Refunds may be issued for accidental purchases under the following conditions:
- Purchasing multiple of the same package under the same account
- Accidentally buying mass amounts of the same package
- Contacting us within 10 minutes of the purchase
- We are not liable for purchases made without the permission of a parent/guardian, but may refund these as we see fit.
- Undelivered or Broken Products
- If a purchase does not process within a reasonable amount of time, or if the listed privileges of the package are incorrect or broken, please contact our support immediately. We will make every effort to correct the issue. If the product cannot be delivered as described, a refund may be considered.
- Blacklists and Punishments
- We will not issue refunds for server blacklists or punishments. You are responsible for reading and following our rules.
- Chargebacks
- Chargebacks are not an acceptable method of obtaining a refund. Any fraudulent chargeback will result in a permanent blacklist from our network
- Not Grounds for a Refund
- Service downtime, deciding you no longer want the rank or perks, wanting to use the money for something else, maintenance, server relocation, suspension from the server, or disagreeing with a decision made by PvPHub staff are not valid reasons for a refund.
Limitation of Liability
PvPHub website, server, and any other services or content provided is made available and provided to you at your own risk. It is provided to you as-is and we expressly disclaim all warranties of any kind, expressed or implied, including but not limited to the warranties of merchantability and non-infringement. You understand and agree that neither PvPHub nor any participant in the service provides professional advice of any kind and thus use of such advice or any other information is solely at your own risk and without our liability of any kind.
PvPHub and its members shall not be liable for any special or consequential damages, even if we have been advised of the possibility of such damages, resulting from or arising out of the use of or the inability to use the service, the cost to obtain substitute goods and/or services resulting from any transaction entered into or through the service, unauthorized access to or alternation of your data transmissions, statements or conduct of any third party on the service, or any other matter relating to the service. Note that by accepting the terms in the document, you are also waiving your right, to take any action, legal or otherwise, against anyone or anything related to the staff, management, administrators, members, owners or any hosts of this server. You furthermore acknowledge that if any part of this document is found to be invalid or unenforceable in any way, any parts not found to be invalid or unenforceable will be considered fully valid and binding.
Use of Site
Do not misuse our Services. For example, do not interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct. Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from its owner. These terms do not grant you the right to use any branding or logos used in our Services. Do not remove, obscure, or alter any legal notices displayed in or along with our Services.
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including an PvPHub or other licensed administrator, host, or representative, as well as other members or visitors on the site and its services is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.
Prohibited Behavior
Upon joining The PvPHub server or creating an account on any related website, you agree NOT TO:
• use or encourage others to use The PvPHub server or related websites for any illegal purpose;
• impersonate any PvPHub Staff member in the game or on any other web site;
• make unsolicited or inappropriate offers, advertisements or proposals for goods, services or other commercial activities that are not related to the PvPHub server;
• interfere with any security-related features of the PvPHub server or related websites;
• harass members or guests of PvPHub;
• engage in any other conduct prohibited by Staff and or Rules;
• release or distribute server access information without Staff consent.
• save (in any form other than temporary Minecraft or browser server packets required for viewing and intended interaction), reproduce, mimic, or otherwise copy any content on the PvPHub server or associated websites or services, for either personal use or public distribution, unless you you hold the sole, original copyright on that content.
• release or distribute any server content without Staff consent (with the exception of unaltered content to which you hold the sole, original copyright)
Termination and Suspension of Access
Players found violating the Terms of Service may find their accounts or IP addresses restricted or eliminated from our Services. This includes, but is not limited to, PvPHub.me. In addition, staff retain the right to kick you, ban you, or block your access to the the server or any other affiliated websites or services for any other reason, without explanation or warning. While some players may appeal their bans as a courtesy, server staff retain the right to revoke any request for a ban appeal.
Notice
PvPHub.me may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to PvPHub.me. The Services that PvPHub provides are always evolving and the form and nature of the Services that PvPHub provides may change from time to time without prior notice to you. In addition, PvPHub may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally and may not be able to provide you with prior notice. We also retain the right to create limits on use and storage at our sole discretion at any time without prior notice to you.
The Services may include advertisements, which may be targeted to the Content or information on the Services, queries made through the Services, or other information. The types and extent of advertising by PvPHub on the Services are subject to change. In consideration for PvPHub granting you access to and use of the Services, you agree that PvPHub and its third party providers and partners may place such advertising on the Services or in connection with the display of Content or information from the Services whether submitted by you or others.
General
Owners retain the right to modify these terms at any time without warning. You agree that these terms are binding upon you and your heirs, legal representatives, and assigns, in perpetuity.
